EEO/Affirmative Action Forms

The Nondiscrimination, Equal Employment, and Affirmative Action program compliance is required before a contract is awarded by the City of Los Angeles.

The City of Los Angeles adopted this program to protect the interest of people working for contractors doing business with the City. This is to remind potential contractors of their responsibility to ensure that their companies are free of discrimination and show the effort to employ a racially-diverse work force, one that mirrors the diversity of the LA area. Contractors are expected to:

  • follow unbiased employment practices; and
  • maintain proper personnel records.

The City looks at this as an Outreach Program. There are no goals or quotas required for your hiring or employment levels. This is one reason why this program overcame legal challenges posed by Proposition 209. The guidelines are taken from the Los Angeles Administrative Code Manual.

City funded projects require the completion of the 7-page Nondiscrimination, Equal Employment, Affirmative Action program form package (AA001 7/6/00).

Federally funded projects require the completion of the 5-page Equal Employment/Affirmative Action Certification (FedPreBid01 1/2001).

Proposers that want to bid on a project together with another partner company as joint-venture need to each submit the required 7-page Nondiscrimination/Equal Employment Practices/Affirmative Action form (AA001 7/6/00) or the 5-page Equal Employment /Affirmative Action Certification (FedPreBid01 1/2001).

Requirements of the Nondiscrimination/Equal Employment/Affirmative Action Form (AA001)
  1. Designate as an Equal Employment Opportunity Officer an individual that has authority over personnel matters, and enforce EEO/AA regulations.
  2. The Total Composition of Work Force on page A-2 must contain a headcount of your current employees, broken down by ethnicity and the positions they have in your company. Employee data will not give a bidder an advantage or disadvantage on this proposal.
  3. Sign pages A-1 & A-7 to acknowledge your understanding and acceptance of the City's Nondiscrimination/ Equal Employment / Affirmative Action requirements.

The other pages of this form outlines the guidelines for contractors to follow in outreaching to various labor sources for their manpower needs, hiring practices, employee training, and records to maintain.

A winning contractor's subcontractors must also submit ND/EE/AA form package.

Requirements of the Equal Employment/Affirmative Action Certification (FedPreBid01)
  • The Equal Employment Opportunity Officer page requires the proposer to designate an individual that has authority over personnel matters, and enforce EEO/AA regulations.
  • The Ethnic Composition of Total Work Force page must show a headcount of your current employees, broken down by ethnicity and the positions they have in your company. Employee data will not give a bidder an advantage or disadvantage on this proposal.
  • The Debarment and Suspension Certification requires the proposer to disclose any current or past debarment or suspension rendered to their company.
  • The Certification with Regard to the Performance of Previous Contracts requires the proposer to disclose if they have worked in a federally-funded project and have filed the necessary federal reports for those projects.
  • The Certification of Non-Segregated Facilities requires the proposer to certify that they do not maintain segregated areas for common employee facilities based on race, color, religion or national origin.
  • A winning contractor's subcontractors must also submit this certification package.
